1. Agreement to Terms

By accessing our website or utilizing our collision repair services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services. These terms apply to all visitors, users, and others who access or use the Service.

2. Estimates and Authorizations

All initial estimates provided, whether online based on photographs or in-person, are preliminary. Hidden damage is common in collision repair and may require a revised estimate (supplement) once the vehicle is disassembled. No repair work will commence without your explicit authorization or the authorization of your designated insurance carrier. You agree that preliminary estimates are not binding contracts for a final repair price.

3. Parts and Materials

We strive to use Original Equipment Manufacturer (OEM) parts whenever possible to ensure the highest quality repair. However, your insurance policy may dictate the use of aftermarket, reconditioned, or recycled parts. We will communicate the types of parts being used in your repair plan prior to installation. JRS Body Inc is not responsible for the quality or fitment issues arising from insurance-mandated alternative parts.

4. Payment and Liens

Full payment is required upon completion of the repair before the vehicle is released. We accept insurance checks, major credit cards, and certified funds. We reserve the right to place a mechanic's lien on any vehicle for which payment has not been received in full for authorized repairs. Storage fees may apply for vehicles left on our premises for more than 48 hours after completion notification.

5. Vehicle Contents and Condition

While we take every precaution to secure your vehicle while it is in our care, we are not responsible for loss or damage to personal items left inside the vehicle. Please remove all valuables, electronics, and personal belongings before dropping off your vehicle. We are also not responsible for pre-existing mechanical issues or damage not related to the contracted repair.

6. Timelines and Delays

Any estimated completion dates provided are approximations based on initial damage assessment and current parts availability. Repair timelines may be extended due to hidden damage discovery, delayed insurance approvals, or national parts backorders. We will make reasonable efforts to keep you informed of significant changes to the repair schedule, but we are not liable for incidental expenses (such as rental car costs) resulting from unavoidable delays.

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of JRS Body Inc and its licensors. The website is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of JRS Body Inc.

8. Limitation of Liability

In no event shall JRS Body Inc, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service or our physical repair services, beyond the direct cost of the repair in question.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the state in which JRS Body Inc operates, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

10. SMS Communications and Consent

JRS Body Inc and Skint Knuckles Garage LLC send text messages only to people who opt in by checking a text-message box on our forms. Service texts cover your estimate or appointment request, reminders, scheduling, repair or service updates, and vehicle pickup. Marketing texts (offers and service specials) are sent only if you separately check the marketing box. Neither box is required to purchase, book or receive service. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time, or HELP for help. Carriers are not liable for delayed or undelivered messages. Our Privacy Policy explains how we handle your information.

You must be at least 18 years old to subscribe to our text messaging program.

11. Arbitration Agreement and Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by individual arbitration rather than in court. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

12. Disclaimer of Warranties

While our physical repair services carry the workmanship warranty set out on our Warranty page, our digital services, including preliminary online estimates, are provided on an "AS IS" and "AS AVAILABLE" basis. JRS Body Inc makes no representations or warranties of any kind, express or implied, regarding the accuracy, adequacy, validity, reliability, or completeness of any information on the site.

13. Indemnification

You agree to defend, indemnify, and hold harmless JRS Body Inc and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses resulting from or arising out of your use and access of the Service or a breach of these Terms.

14. Force Majeure

JRS Body Inc shall not be liable for any failure to perform its obligations where such failure is as a result of Acts of Nature (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities, civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalization, government sanction, blockage, embargo, labor dispute, strike, lockout, or interruption or failure of electricity or telephone service.
